FunkeeFoam Terms and Conditions

This Service Agreement ("Agreement") is made between the undersigned Customer ("you" or "Customer") and FunkeeFoam LLC ("FunkeeFoam"), a limited liability company, for the booking and delivery of foam party services at the event location you specify during checkout ("Event").

By checking the box and submitting your booking, you acknowledge that you have read, understood, and agreed to the following terms and conditions:

1. Assumption of Risk

Participation in a foam party involves inherent risks, including but not limited to slipping, falling, and potential skin or eye irritation. By attending or participating, you and your guests voluntarily assume all risks, known and unknown, associated with the Event.

2. Release of Liability and Indemnification

To the fullest extent permitted by law, you agree to release, hold harmless, and indemnify FunkeeFoam LLC, its owners, employees, contractors, and affiliates from any and all claims, damages, losses, or expenses (including legal fees) arising from participation in the Event. This includes claims made by you, your guests, or third parties, whether due to negligence or otherwise.

3. Safety Disclosures

Surfaces at the Event may be wet and slippery — caution is required.
Foam may irritate the skin or eyes in certain individuals. Participants with allergies, open wounds, or skin conditions should consult a physician prior to participation.
Foam is not intended for ingestion and should be rinsed off the skin promptly after the Event.
After the Event, participants should remove wet clothing, bathe, and moisturize to prevent skin dryness or irritation.

4. Foam Limitations & Property Risk

Foam performance depends on weather, humidity, water quality, flooring type, and crowd size. FunkeeFoam does not guarantee a specific foam output or duration.

Foam may damage surfaces, similar to water. You are responsible for protecting floors, furniture, landscaping, and other property.
Colored or UV foam may stain porous materials if not rinsed within 24 hours. Use caution when selecting a foam zone.

5. Photography and Media Consent

By participating, you grant FunkeeFoam permission to photograph or record the Event and to use such content for marketing or promotional purposes, without compensation or further consent.

6. Payment Terms and Cancellations

A 50% non-refundable deposit is due at the time of booking.
Full payment is required at least 72 hours before the Event.
If you cancel, the deposit will not be refunded.
If FunkeeFoam cancels due to weather or other circumstances, your deposit will be fully refunded.
No refunds will be issued once the Event has started.

7. Damage to Equipment

You are responsible for any damage caused to FunkeeFoam’s equipment due to the actions of you, your guests, or vendors during the Event.

8. Permits, Laws, and Ordinances

You are responsible for obtaining all required permits and ensuring the Event complies with local ordinances, noise restrictions, or community rules. Any resulting fines or issues are your responsibility.

9. Force Majeure

FunkeeFoam will not be held liable for delays or failure to perform due to causes beyond its control, including weather, power outages, accidents, or government restrictions.

10. Governing Law and Venue

This Agreement is governed by the laws of the State of [Insert State]. Any disputes arising under this Agreement shall be resolved exclusively in the courts of [Insert County], [Insert State], and you consent to jurisdiction in those courts.

11. Entire Agreement

This Agreement contains the entire understanding between you and FunkeeFoam and supersedes all prior communications or understandings. No changes are valid unless made in writing and acknowledged by both parties.

By checking the box during the booking process, you confirm that:

You have read and understood this Agreement;
You agree to be legally bound by its terms;
You are at least 18 years old and authorized to accept these terms on behalf of your party.
